By clicking “Buy Now,” “Purchase,” or any other phrase on the purchase button, entering your credit card information, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client”) agree to be provided with products, programs, or services by HP Resume Co. (“Resume Writer”), acting on behalf of HP Resume Co. (“Company”), and you are entering into a legally binding agreement with the Company, subject to the following terms and conditions:
1. TERMS.
(a) Upon execution of this Agreement, electronically, verbally, or otherwise, the Resume Writer agrees to provide services in accordance with the Resume Writing Services “My First Resume” Package.
(b) The scope of services rendered by the Resume Writer pursuant to this contract shall be solely limited to those contained therein and/or provided for on Resume Writer’s Website www.hpresumeco.com as part of the Program.
(c) Resume Writer reserves the right to substitute services equal to or comparable to the Program for Client if reasonably required by the prevailing circumstances.
(d) Client agrees to be open, present and prepared to complete the work. Client is responsible for his/her own success and implementation of objectives met.
(e) Resume Writer reserves the right to remove Client from the project at any time for any reason.
(f) The package includes the items listed on the website that Client purchased.
(g) Due to time constraints, resume writing services do not include phone support. All communication with the client related to resume writing services will be held electronically via e-mail.
(h) Depending on the number of pages, complexity, and fluency in communication with the client, the average turnaround time to deliver the final resume is 10 business days (generally less) from the starting date once payment is received. If the client purchases a package that includes additional services, the average turnaround time is ten more business days. To ensure the quality of the final product, it is important to keep fluent communication with the Resume Writer.
(i) The rewriting and reformatting process focuses on online applications, and the technology widely utilized by corporations and job boards to filter and screen resumes (Applicant Tracking Systems).
(j) Once the resume writing process starts, due to the high demand for HP Resume Co. services, if the client does not communicate with Resume Writer during the following five (5) business days, the project will be considered complete at the stage it was at the time the draft was delivered. No refund will be issued.
(k) During the five business days following the final delivery, the client can request further editing/modifications. If, after this period the client does not say otherwise, the delivered final version will be considered accepted.
2. METHODOLOGY. Client agrees to be open minded to Resume Writer’s methods and partake in services as proposed. Occasionally, Resume Writer may utilize AI and other cutting-edge technology and tools to enhance the content. Client understands that Resume Writer has made no guarantees as to the outcome of the Resume Writing sessions or Program. Resume Writer may revise methods or parts of the Program based on the needs of the Client.
(a) Once payment clears, the Client will receive a call or a questionnaire that will help Resume Writer better understand client's background, experience, and skills. The questionnaire should be answered and sent back to Resume Writer within 48 hrs.
(b) Once the Resume Writer and Client have a conversation, or the Client answers a questionnaire and sends it back, Resume Writer will start working on the resume.
(c) The Client will receive their draft(s) for review.
(d) Each draft (pending package) will include questions/comments that will help Resume Writer better understand the client’s experience and background. For this reason, it is essential the client be timely, cooperative, and involved during this process.
(e) All drafts must be sent back to Resume Writer within five (5) business days (preferably sooner) from the date the original draft was sent for Client's review. If the Client can't commit to sending back the edited drafts within this time frame, the project will be considered complete, and no refund will be issued.
(f) All drafts must be edited by the Client in an original email sent by Resume Writer and must be sent back to Resume Writer in Microsoft Word only. PDF, Google Docs, and any other type of files will not be accepted.
(g) After Client's approval of the 1st or 2nd draft (pending package), they will receive the final package with the items described in TERMS.
(h) LinkedIn Profile Update - Due to LinkedIn privacy terms and conditions (and privacy in general), the Resume Writer doesn't work with the client's password, instead, the Resume Writer will deliver a LinkedIn Profile Creator or Update. This is a step-by-step guide with content that the Client can copy and paste directly onto their LinkedIn account. There are some areas that will require the Client to manually enter the information in specific fields such as LinkedIn URL, work experience, and recommendations among others.
This is a non-interactive process like resume writing where the Client interacts with the Resume Writer through drafts. There are no drafts involved in the LinkedIn Profile Creator or Update process.
Once the Resume Writer delivers the LinkedIn Profile Creator or Update, the process will be considered complete and it is at the Resume Writer's discretion to answer questions regarding the Client Profile and/or review the work/changes made by the Client to their LinkedIn profile.
3. DISCLAIMERS. By collaborating with HP Resume Co., Client acknowledges that Resume Writer creates and composes resumes, cover letters, and LinkedIn Profiles based on the information provided by the Client through an existing resume, the initial questionnaire, face to face intake call, phone conversation, and possibly through other supporting materials. Although Company takes pride in offering high-quality resume writing services, utilizing our services does not guarantee an interview or a job.
The Resume Writer may provide the Client with information relating to products that the Resume Writer believes might benefit the Client, but such information is not to be taken as an endorsement or recommendation. The Resume Writer is not responsible for any adverse effects or consequences that may result, either directly or indirectly, from any information or Resume Writing provided.
The Resume Writer may provide Client with third-party recommendations for such services as marketing, photography, training, business, or other related services. The client agrees that these are only recommendations, and the Resume Writer will not be held liable for the services provided by any third-party to the Client. The Resume Writer is not responsible for any adverse effects or consequences that may result, either directly or indirectly, from any information or services provided by a third-party.
Any testimonials, earnings, or examples shown through Resume Writer’s website are only examples of what may be possible for Client. There can be no assurance as to any particular outcome based on the use of Resume Writer’s programs, courses, and/or services. Client acknowledges that Resume Writer has not and does not make any representations as to a future outcome of any kind that may be derived because of use of Resume Writer’s website, programs, products or services.
4. PAYMENT AND REFUND POLICY.
(a) Upon execution of this Agreement, Client agrees to pay to Company the full purchase amount.
(b) Due to the creative nature of resume writing, all sales are final. Company does not offer refunds.
(c) If Client selects a payment plan option, Client agrees to pay fees to Company according to the payment schedule set forth on Company’s website, or otherwise provided to Client, and the payment plan selected by Client (the “Fee”).
(d) Credit Card Authorization (if applicable for payment plan). Each Party hereto acknowledges that HP Resume Co. will charge the credit card chosen by the Client.
(e) In the event Client fails to make any of the payments within a payment plan during the time prescribed, Resume Writer has the right to immediately terminate participation by Client until payment is paid in full, including disallowing access to materials. If Client has not paid within fourteen (14) days, Resume Writer has the right to terminate agreement.
5. INTELLECTUAL PROPERTY RIGHTS. In respect of the documents specifically created for the Client as part of this Program, the Resume Writer maintains all the copyright, other intellectual property rights and any other data or material used or remaining in the Material whether finished or unfinished. Client receives one license for personal use of any content provided by Resume Writer. Nothing in this Agreement shall transfer ownership of or rights to any intellectual property of the Resume Writer to the Client, nor grant any right or license other than those stated in this Agreement. The Resume Writer reserves the right to immediately remove Client from the project without refund, if you are caught violating this intellectual property policy.
6. NON-DISPARAGEMENT. The Parties agree and accept that the only venue for resolving a dispute shall be in the venue set forth herein below. The Parties agree that they neither will engage in any conduct or communications with a third party, public or private, designed to disparage the other. Neither Client nor any of Client’s associates, employees or affiliates will directly or indirectly, in any capacity or manner, make, express, transmit speak, write, verbalize or otherwise communicate in any way (or cause, further, assist, solicit, encourage, support or participate in any of the foregoing), any remark, comment, message, information, declaration, communication or other statement of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory or critical of, or negative toward, the Resume Writer or any of its programs, affiliates, subsidiaries, employees, agents or representatives.
7. GOOD FAITH. Each party represents and warrants to the other that such party has acted in good faith, and agrees to continue to so act, in the negotiation, execution, delivery, performance, and any termination of this Agreement.
8. DISCLAIMER OF WARRANTIES. The information, education, and Resume Writing provided to the Client by the Resume Writer under this Agreement are provided on an “as-is” basis, without any warranties or representations express, implied or statutory, including, without limitation, warranties of quality, performance, non-infringement, merchantability or fitness for a particular purpose. Nor are there any warranties created by a course of deal, course of performance or trade usage.
9. LIMITATION OF LIABILITY. By using HP Resume Co. and purchasing this Package, Client accepts all risks, foreseeable or non-foreseeable, arising from such transaction. Client agrees that Resume Writer will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Package. Client agrees that use of this Package is at user’s own risk.
10. DISPUTE RESOLUTION. If a dispute is not resolved first by good-faith negotiation between the parties to this Agreement, any controversy or dispute to this Agreement will be submitted to the American Arbitration Association. The arbitration shall occur within ninety (90) days from the date of the initial arbitration demand and shall take place in Reading, PA or via telephone. The Parties shall cooperate in exchanging and expediting discovery as part of the arbitration process and shall cooperate with each other to ensure that the arbitration process is completed within the ninety (90) day period. The written decision of the arbitrators (which will provide for the payment of costs, including attorneys’ fees) will be absolutely binding and conclusive and not subject to judicial review, and may be entered and enforced in any court of proper jurisdiction, either as a judgment of law or decree in equity, as circumstances may indicate.
11. GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the laws of the State of PA, within USA, regardless of the conflict of laws principles thereof.
12. ENTIRE AGREEMENT. This Agreement contains the entire agreement between the parties and supersedes all prior agreements between the parties, whether written or oral.
